SFMTA "It's T Time" Sweepstakes  

Official Rules  

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. MAKING A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.  

1. Sponsor and Administrator  

The San Francisco Municipal Transportation Agency (“SFMTA” or “Sponsor”) is the sole sponsor and administrator of the "It's T Time" Sweepstakes ("Sweepstakes").  

The Golden State Valkyries, LLC are donating prizes only. The Golden State Valkyries do not sponsor, administer, endorse, or otherwise have any affiliation with this Sweepstakes.  

2. Eligibility  

The Sweepstakes is open to legal residents of the United States who are 18 years of age or older at the time of entry.  Entrants must be an authorized holder of the email account used to enter the Sweepstakes. Employees of SFMTA who are directly involved in administering the Sweepstakes, employees of the Golden State Valkyries, and the immediate family members and household members of such employees are not eligible to participate.  

The Sweepstakes is subject to all applicable federal, state, and local laws and regulations.  The Sweepstakes is offered and valid in the 50 United States and District of Columbia, excluding Rhode Island; void where prohibited.  

3. Agreement to Official Rules  

By participating in this Sweepstakes, you agree to be fully and unconditionally bound by these Official Rules and by the decisions of SFMTA, which are final and binding in all matters relating to the Sweepstakes. By entering, you represent and warrant that you meet all eligibility requirements. By participating in the Sweepstakes, the Entrant represents and warrants that they have read and understood, and agree to be bound by, these Official Rules. The selected potential winner must continue to comply with these Official Rules, and all winnings are contingent upon fulfilling all requirements.  

4. Sweepstakes Period  

The Sweepstakes begins at 10:30 a.m. Pacific Time on Monday, September 21 and ends at 11:59 p.m. Pacific Time on Thursday, September 24 ("Entry Period").  

Entries received before or after the Entry Period will not be eligible.  

9. Publicity  

Except where prohibited by law, acceptance of a prize constitutes the winner's permission for SFMTA to use the winner's name, city of residence, submitted photograph, and likeness for promotional and public information purposes relating to this Sweepstakes without additional compensation.  

The Winner, by accepting the prize, grants to the Sponsor and its respective designees the right to include Winner’s last name and first name on a “Winners List” that is available to the public upon request. The winner acknowledges that the Winners List is a public document and holds the Sponsor and the Released Parties harmless from any use of the Winners List by the public.  

10. General Conditions  

SFMTA reserves the right, in its sole discretion, to cancel, suspend, modify, or terminate the Sweepstakes if fraud, technical failures, unauthorized intervention, or any other factor beyond SFMTA's reasonable control impairs the integrity or proper administration of the Sweepstakes.  

SFMTA also reserves the right to disqualify any entrant who tampers with the entry process or violates these Official Rules.  

By participating in the Sweepstakes and submitting entries electronically, each Entrant agrees that the Released Parties are not responsible for stolen, late, incomplete, inaccurate, misdirected, lost, damaged, delayed, postage-due or garbled entries, email or mail; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or problems of any kind whether human, mechanical, electronic, network, computer, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes, or in any Sweepstakes related materials.  Released Parties are not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participants or to any other person's computer related to or resulting from participating in the Sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Sweepstakes or website or attempt to undermine the legitimate operation of the Sweepstakes by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or Sponsor's representatives or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsor and its respective agents. Sponsor shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in its sole discretion. Released Parties (i) make no warranty, guaranty or representation of any kind concerning any prize, and (ii) disclaim any implied warranty. Any failure by Sponsor to enforce any of these Official Rules shall not constitute a waiver of that provision. This Agreement will be governed by the laws of the State of California. Any court of competent jurisdiction sitting within San Francisco, California will be the exclusive jurisdiction and venue for any dispute arising out of or relating to these Official Rules. Entrants hereby waive any argument that any such court does not have jurisdiction or improper venue regarding any and all disputes arising out of the Sweepstakes, including the award of prizes. The Sponsor shall be entitled to recover their court costs and reasonable attorneys’ fees and expenses incurred in successfully proving any breach of any term of these Official Rules. The Sponsor reserves the right, in its sole discretion, to amend, modify, cancel or suspend the Sweepstakes prior to award of prizes. Entries generated by a script, macro or other mechanical or automated means will be disqualified. All online entries must be submitted from a valid email account for the Entrant. In case of multiple entries received from an account, or multiple email entries, only the first entry received from such account or email account will be considered. In the event of dispute as to the identity or eligibility of the Winner based on an email account, the winning entry will be the "Authorized Account Holder" of the email account, at the time of entry provided, provided that Authorized Account Holder is also named in the entry form as the Entrant and provided such Entrant/Authorized Account Holder is eligible according to these Official Rules. The Winner may be required to prove that they are the Authorized Account Holder of the entered email account, which is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address  

11. Limitation of Liability  

 By participating in the Sweepstakes, Entrants waive any and all claims against any and all other entities or individuals associated with the development/execution/administration/promotion/fulfillment of the Sweepstakes, the City and County of San Francisco, the San Francisco Municipal Transportation Agency, the Golden State Valkyries, LLC, and all of their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”), and release the Release Parties from and against any liability for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, arising out of participation in the Sweepstakes, or from the receipt or use of any prize or prize-related activity. Released Parties will not be responsible for acts of third parties, acts of God, acts of terrorism, pandemic, civil disturbances, work stoppage, natural disasters, or any other natural disaster events outside their control that may cause the cancellation or postponement of awarding prizes. All prizes are non-transferable and non-assignable, with no cash redemptions. Sweepstakes entrants acknowledge and agree that by entering the Sweepstakes, Entrants are providing information to the Sponsor for use in connection with the Sweepstakes and authorize the use of such information  

I SPECIFICALLY UNDERSTAND AND AGREE THAT THIS RELEASE WILL PREVENT ME AND MY SUCCESSORS FROM BRINGING A LAWSUIT, CLAIM OR OTHER ACTION AGAINST THE SPONSOR OR ANY OTHER RELEASED PARTY AND FROM RECOVERING ANY MONEY DAMAGES OR OTHER LEGAL RELIEF FROM THE SPONSOR OR ANY OTHER RELEASED PARTY IN CONNECTION WITH ANY OF THE CLAIMS RELEASED ABOVE.  

I further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. I acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”  

12. Privacy  

Any personal information collected in connection with the Sweepstakes will be used solely for the administration of the Sweepstakes and in accordance with applicable law and SFMTA's privacy policies.  

13. Disputes  

This Sweepstakes shall be governed by the laws of the State of California without regard to its conflict of law principles. Any disputes arising from or relating to the Sweepstakes shall be resolved in a court of competent jurisdiction located in the State of California.  

14. Winners List  

To request the names of the winners, send an email with the subject line "It's T Time Sweepstakes Winners" to socials@sfmta.com within sixty (60) days following the winner announcement.
